Terms of service

 

 

Both parties agree to the following:

Beach Bum Rentals will deliver beach equipment to the customer named in this agreement. It is their responsibility to read terms and conditions. The services/products provided would be in accordance with our published list of services/products that you have chosen. Beach Bum Rentals wants your vacation to be as fun and relaxing as possible. If however, certain events beyond our control should prevent us from meeting our high standards, Beach Bum Rentals is to be held blameless. We will nevertheless, do everything in our power to rectify the situation that is outside our normal control. Payments are due in full while scheduling services. If due to severe weather you may reschedule location, date, and time, as long as the date and time you are requesting are available. Your payments will be refunded 50% of original payment if cancelled within 14 days of scheduled service. We will transfer all payments to the new date if there is a rescheduling.

 Hold Harmless Clause:

This document is to clarify that the customer shall assume all risks, incident to or in connection with the rented equipment and shall be solely responsible for damage, injury, of whatever kind or nature, to person or property, directly or indirectly arising out of or in connection with the rented equipment.

The customer shall also be responsible for damage or injury, of whatever kind or nature, to person or property, directly or indirectly arising out of or in connection with the rented equipment. The customer hereby expressly agrees to defend and save Beach Bum Rentals harmless from any penalties for violation of any law, ordinance, or regulation affecting its activity and from any and all claims, suits, losses, damages, or injuries directly or indirectly arising out of or in acts or omissions of the customer and its rented equipment.

CHANGE / CANCELLATION:

Any changes/cancellations made to this contract must be made in writing and signed by all parties.

In the event the customer is forced to change the date or location of the services, every effort will be made by Beach Bum Rentals to accommodate the new date or location.

 There may also be additional charges above and beyond those set in the original contract. The customer understands that last-minute changes can impact the quality of the services and that Beach Bum Rentals is not responsible for these compromises in quality.

If the customer changes the date/location of the scheduled services and Beach Bum Rentals is unavailable to provide services, then Beach Bum Rentals is released from all contract obligations and shall in no way be held responsible or liable for non-performance.

 

 

Cancellation by the customer:

In the event of a cancellation, refunds are limited to 2 weeks prior to scheduled services. 

 

Cancellation by Beach Bum Rentals:

Should Beach Bum Rentals be unable to perform any specific tasks in the outlined services provided, due to the illness or hospitalization, payments will be refunded. Beach Bum Rentals is not responsible for any events preventing the services, such as fire, flood, earthquake, or any other natural or human acts.

 

Location:

Beach Bum Rentals will drop off rentals at the location input into SHIPPING ADDRESS during checkout. Beach Bum Rentals is not responsible for any mistakes the customer makes when providing a dropoff location. The customer is responsible for returning all rentals to the provided address for pick up before checkout.

 

Damage or Theft:

We ask all customers to treat our equipment with respect. Customers are held responsible for damaged or stolen items and will be charged accordingly up to the full value of the item. No equipment should be left unattended under ANY circumstance. All bikes come with bike locks that must be used. If any equipment is returned dirty (Food, sunscreen, dirt stains ect) a $10 cleaning fee will be charged per dirty item returned.

 

Force Majeure:

In the event that any cause beyond the reasonable control of either party, including without limitations acts of GOD, war, curtailment or interruption of transportation facilities, threats or acts of terrorism, State Department travel advisory, labor strike or civil disturbance, make it inadvisable, illegal, or impossible, either because of unreasonable increased costs or risk of injury,

 

Permission to use Photograph:

I agree that Beach Bum Rentals may use such photographs of me, my family, and friends, with or without my name and for any lawful purpose, including for example such purpose as publicity, illustration, advertising, and Web content.

 

Licensed and Insured:

Beach Bum Rentals is licensed and insured.
